Refinancing or paying off an auto loan can end the old loan without automatically resolving every GAP refund question. Review the GAP contract, identify the cancellation process and ask whether an unused portion is refundable. Availability, calculation and timing are contract- and jurisdiction-dependent.

Identify the product and administrator

Find the signed GAP agreement, purchase price and original loan details. Ask who handles cancellation and who issues the refund: the lender, dealer or coverage provider. Do not assume a refinance transfers the old GAP to the new loan. Wells Fargo's FAQ offers a provider-specific example of nontransferable GAP and potential refunds; confirm the terms of your own product.

Keep proof of payoff or refinance and submit any required request through a verified channel. Ask how the refund is calculated and whether mileage, elapsed time or other adjustments matter. A straight-line estimate may be a planning tool, but it is not the contractual amount.

Reconcile where the money went

A refund may be credited to an outstanding account rather than sent as cash. Ask for the posting date and updated balance. If the old account was already satisfied, verify the payment recipient and mailing or delivery details. Track the response without assuming one provider's processing period is a national deadline.

The relevant primary reference is CFPB: guaranteed asset protection. Read its scope before applying it to a different lender or loan type.

A working checklist

Record or questionWhy it matters
GAP agreement and purchase dateIdentifies the correct product and terms.
Payoff or refinance confirmationDocuments the event behind the request.
Refund calculation and issuerClarifies amount and responsibility.
Credit or payment evidenceShows whether the refund was actually received.

A hypothetical case to work through

Suppose an invented borrower estimates a $450 unused refund after refinancing. The administrator later calculates $380 under the contract. Before disputing the $70 difference, ask for the calculation and relevant terms. If $380 is credited to an old outstanding balance, it is not also a $380 cash payment available for the new loan.

Practical questions

Does every GAP product refund unused cost? No. Read the contract and applicable rules.

Will a refund lower my regular new-loan payment? Do not assume so. The old product and new loan are separate arrangements.
